What is the Definition of a Seaman Under the Jones Act

Individuals who work offshore and on the water must be very careful when they sustain an injury at work. Most of these individuals will qualify as "seamen" under a Federal statute known as the Jones Act. The Jones Act allows an injured maritime worker to file a tort-based lawsuit against their employer and seek all damages caused by the injury including pain and suffering, lost wages and loss of fringe benefits. However, in order to file suit under the Jones Act the maritime worker must first meet the definition of a "seaman" under the Jones Act. This definition states that the employee must be "more or less permanently assigned to a vessel or fleet of vessels in navigation."

The initial requirement is that the injured employee be "more or less permanently" assigned to vessels or fleets of vessels. The more or less permanently has generally been interpreted to mean that the employee spends at least 30% of his working time aboard a vessel or fleet of vessels. This has come to be known as the "30% Rule". Usually this initial requirement is one of the easier requirements for the employee to satisfy since most maritime workers either spend a great deal of their time aboard vessels or they work land-based or fixed-platform jobs.

The second requirement in order to satisfy the definition of a "seaman" is that the employee must be assigned to work aboard a "vessel". Any type of traditional vessel such as a tug boat, crew boat, supply boat or other clearly defined United States Coast Guard vessels certainly satisfy this second requirement. However, in the Gulf of Mexico very many special purpose structures such as jack-up drilling rigs, semi-submersible drilling rigs and drill ships also have been defined as a vessel under the Jones Act. The United States Supreme Court has stated that any structure that is "practically capable of navigation" can meet the definition of a vessel under the Jones Act.

It should also be noted under the definition of vessel that the employee does not necessarily have to be assigned to one specific vessel. The Jones Act allows an employee to qualify as a seaman even if he is assigned to several vessels which constitute a fleet of vessels. However, there is a requirement that this fleet of vessels be under common ownership or control. In other words, typically individuals who are randomly assigned to vessels owned, operated and controlled by many different parties will have a difficult time establishing that they were assigned to a fleet of vessels under common ownership or control. Austin wireline workers as well as other specialized workers in the Gulf of Mexico face this challenge in satisfying the definition of a seaman under the Jones Act.

The third requirement in order to satisfy the definition of a seaman under the Jones Act is that the individual be assigned to a vessel that is "in navigation". This requirement has been very broadly defined and essentially means any individual that is in some way contributing to the mission of the vessel, a term that is also broadly defined. Typically the "in navigation" requirement will easily be met.

Satisfying the definition of a seaman under the Jones Act can be critically important for an injured Maritime worker to fully recover due to an injury offshore. Only by meeting the definition of a seaman will the injured employee be allowed to file suit under the Jones Act. And only under the Jones Act will the injured employee collect lost wages, pain and suffering, past and future medical expenses as well as other compensation for his injury. If the injured employee does not meet the definition of a seaman, he will not be allowed to file a negligence, tort type lawsuit against his employer. Instead, he will be restricted to recovering only workers' compensation type benefits which typically do not fairly compensate the employee.

Growth of dahlias comes from buds on this old stem; therefore every tuber must have a part of this parent stem even though it may be very small.

Buyer Beware - whose Side are you on?

Prior to the 1990's, real estate purchase contracts were only two pages and were written to protect the "seller". All real estate professionals pretty much represented the "seller", not the buyer in any transaction. Today, real estate purchase contracts are eleven pages with several pages of addendums and are written to protect the "buyer". In the earlier days of real estate, the agent, hired by the buyer was working for the seller. This meant that everything the buyer discussed with the agent was disclosed to the seller.

Could you imagine telling your agent personal information about your situations, finances, etc. and then they would relay this information to the listing agent of the home you made an offer on? It was assumed by the buyer, the agent was looking out for their best interests.

Now that the rules have changed, real estate agents are now required to discuss in detail an "Agency Disclosure" form which is one part of the purchase contract. This disclosure form explicitly states who the agent represents. This form should be signed by the party that the agent is representing and is by no means a commitment from the buyer. It is only a disclosure and should be signed PRIOR to the writing of a purchase contract.

Over the years I've known several buyers who actually think they will save money by dealing directly with the agent who is the listing agent on a property. This listing agent then writes an offer on behalf of the buyer but the agent's fiduciary duty is to get the highest price for the seller, not the lowest price for the buyer. This strategy can actually cost the buyer thousands of dollars more when the negotiations start.

Being represented "exclusively" by your agent is crucial in a real estate transaction. Here's a good example; you call the listing agent off a sign you see in a front yard and ask them to show you the property. You preview the home, love it and ask to make an offer. When you discuss offer price, you tell the listing agent you would be willing to go higher but you want to start at a lower price. When the listing agent presents the offer to the seller, they can tell their seller you are willing to go higher. So the seller immediately counters your offer with a higher price.

Most buyers don't realize this, but walking into a new home community without a real estate agent can be very costly. That's right, the salesperson at the model homes represents the builder/seller, not you the buyer. So this salesperson has a fiduciary duty to get the builder the highest price possible for the new home.

If the buyer goes to a new home community by themselves and falls in love with one of their models, then they call their agent to meet them there can be disastrous. Most builders will not allow this even if the buyer did not register with the new home subdivision on their first visit. Once you cross that threshold in a new home community, the builder will not allow you to be represented by an agent.

Although the "Buyer Broker Exclusive Employment Agreement" is not standard practice, they should be. This is an agreement between the buyer and the real estate agent which discloses responsibilities and fiduciary duties between both parties. As a buyer, don't you want to know your agent is representing you "exclusively" and the agent will due their due diligence in offering you the best service possible? The agreement by no means forces a buyer to purchase a home, but rather an agreement that discloses loyalty between the buyer and their agent.

No special information is written in stone about the way these things are devised, but we are all so used to hearing music from an early age that contains these rules that we don't even consider about the options until we start to study musical theory in depth.

G# + T = A#

Next, we start with A#, and look at the next alphabetic character in the rule - its a Tone again, so we add 2 half notes to A#, to give us a C:

A# + T = C

Next, we start with a C and find out the formula - now it is a semitone, which takes us to C#:

C + S = C#

If we continue with this we get the following:

C# + T = D# D# + T = F (remember nothing is like an E#) F + T = G G + S = G#

Thus, we have built our scale of G# major according to our major scale formula to get the notes:

G# A# C C# D# F G

Mostly, the scales we use have 7 notes in them but that is not an essential principle. For instance, the minor pentatonic scale only has 5 notes in it (its formula is 3 2 2 3 2 - I used numbers here instead of T and S because it has a few Tone and a half leaps, which is 3 half notes, and that is more easily written down as a 3 instead of something like "T + 1/2", but it all stands for the same thing). Some scales have more notes, for instance the chromatic scale has all 12 notes in it.

Thus in this way the scales act! The formula depicts them and we pick whichever root note we desire to construct. The next step is to convert these notes into a formula so that we can play it.
